Delhi HC upholds the validity of the Agnipath scheme; saying it was introduced in the national welfare

On Monday Delhi High court upholds the constitutional validity of the Agnipath scheme

“The Agnipath scheme was introduced in the national interest and to ensure that the armed forces are better equipped,” the court said.

“This court finds no reason to interfere with the scheme. All petitions are dismissed. We can conclude that the scheme was introduced in the national interest,” the Court said.

“No promissory estoppel or legitimate expectation was created by the advertisements for recruitment,” the bench said.

There were at least 23 petitions filed challenging the scheme. All of the 23 petitions were dismissed by the court. The Supreme Court last year refused to entertain a fresh petition filed by an advocate seeking an investigation into the protests that followed after the introduction of the Centre’s Agnipath scheme.

After the government rolled out the scheme, Protests broke out in several parts of the country. The reason for the protest was due to its shorter tenure and the fewer benefits it offers. The scheme proposes to induct the youth temporarily into the defence forces for a span of four years and they will be known as Agniveers.
